All those who hold the strings of political power and power over spending of Nigeria’s commonwealth have a duty to answer for their conduct when call upon to do so by Nigerians.”<br /> <br /> The plaintiffs also argue that: “It is illegal and unconstitutional for members of the House of Representatives to choose to buy expensive and exotic cars while encouraging Nigerians to tighten their belts and to patronize Nigerian brands. It is also illegal for members to reject cheaper and equally reliable options.”<br /> <a id="more" name="more"></a><br /> <br /> According to the plaintiffs, “If the members of House of Representatives take their duties to the most vulnerable and disadvantaged among us seriously, including their duties to judiciously spend public funds, they would not have voted to spend over $35,000 per car, especially given the current economic and financial realities of Nigeria.”<br /> <br /> “There is chronic poverty in Nigeria and many state governments are unable to pay salaries of workers and pensions. Unless the reliefs sought are granted, the House of Representatives will spend over N5 billion of public funds to buy the exotic cars at the expense of many Nigerians living in poverty and misery.”<br /> <br /> The plaintiffs are asking the court to determine “Whether the proposed plan and resolution by the House of Representatives to buy 400 exotic cars for principal officers and members amounting to over Five Billion Naira in total, is not in breach of Section 57[4] of the Public Procurement Act 2007, the oath of office, and Paragraph 1 of Code of Conduct for Public Officers [Fifth Schedule Part 1] of the Nigerian Constitution of 1999 [as amended].”<br /> <br /> The suit, filed on behalf of SERAP and the concerned Nigerians by their lawyers Kolawole Oluwadare and Opeyemi Owolabi, read in part: “Members of the House of Representatives are either unaware of the constitutional and statutory provisions on their fiduciary duties and judicious use of public funds or deliberately glossing over these provisions.”<br /> <br /> “It is also apparent that, besides elevating their personal interests over and above the public interests, members of the House of Representatives have shown insensitivity to the plight of Nigerians, thereby violating section 14 (2)(b) of the Nigerian Constitution of 1999, to the effect that the security and welfare of the people shall be the primary purpose of government and its institutions.”<br /> <br /> “It is public knowledge that members of the House of Representatives receive huge sums of money as monthly allowances and severance pay on conclusion of their respective terms at the National Assembly. It is rational that many Nigerians are calling for a review downward of the sum proposed to buy cars for members.”<br /> <br /> “There is no better time for any government/public institution to take issues of security and welfare/wellbeing of Nigerians seriously due to rampant kidnapping, banditry and terrorism in many parts of the country than now.”<br /> <br /> “This case raises issues of public interests, national interest, public concern, social justice, good governance, transparency and accountability.”<br /> <br /> “The House of Representatives during an executive session held on 5th February, 2020 reportedly passed a resolution that 400 Toyota Camry 2020 cars be purchased as official vehicles for 360 members and other persons, including top management staff, Chief of Staff to the two presiding officers, as well as some of their special advisers and assistants.”<br /> <br /> “About Three Billion was voted to buy cars for members of the House of Representatives in 2016. The sum of N128 billion was budgeted and allocated to the National Assembly in the approved 2019 national budget.”<br /> <br /> The plaintiffs are seeking the following reliefs:<br /> <br /> A DECLARATION that the plan and resolution to buy 400 Toyota Camry 2020 cars for members of the House of Representatives at the estimated cost of $35,130:00 per car is in breach of Section 57[4] of the Public Procurement Act 2007, Paragraph 1, Code of Conduct for Public Officers [Fifth Schedule Part 1] of the Constitution of Nigeria 1999 and Oath of Office [Seventh Schedule] of the Constitution<br /> <br /> A DECLARATION that the sum of $35,130 per car proposed and voted to buy 400 Toyota Camry 2020 cars for members of the House of Representatives is a breach of the Defendants’ solemn constitutional obligations to know and follow constitutional oaths and other constitutional and statutory provisions governing their conduct, including their duty of care to Nigerians to faithfully protect and defend the Constitution and improve the lives, well-being and welfare of Nigerians<br /> <br /> AN ORDER OF THE COURT restraining and stopping the National Assembly Service Commission from releasing the money to the House of Representatives until an assessment of the impact of the spending on critical sectors like education, security, health, clean water and safe roads is carried out in the public interest in accordance with their constitutional oaths of office and constitutional provisions<br /> <br /> AN ORDER OF THE COURT restraining and stopping all members of the House of Representatives, their assistants, agents, assign or such other person acting on their behalf from demanding or receiving the sum of $35,130 per car for purchase of 400 Toyota Camry 2020 cars until an assessment of the impact of the spending on critical sectors like education, security, health, clean water and safe roads is carried out in the public interest in accordance with constitutional provisions<br /> <br /> AND FOR SUCH FURHTER ORDER(S)that the Honourable Court may deem fit to make in the circumstance of this suit<br /> <br /> No date has been fixed for the hearing of the suit.

The town is located on the Gombi-Biu-Damaturu Road, which shares proximity with Southern Borno and Sambisa Forest.<br /> <br /> Reports say police barracks, churches and a house belonging to Gen Paul Tarfa (retd.) were among several buildings burnt by the terrorists during the attack.<br /> <br /> Meanwhile, the Islamic State’s West Africa Province is said to have claimed responsibility for the attack, alleging that they killed three soldiers and took some worshippers in a church hostage in addition to other villagers in the community.<br /> <a id="more" name="more"></a><br /> <br /> Personnel of the Nigerian Army were said to have engaged the terrorists in a fierce gun battle. But a native of the town, Mr. Joshua Malgwi, told newsmen that many persons were feared killed by the invaders who announced their entry into the town by shooting aimlessly.<br /> <br /> There were also reports that the residents sighted the terrorists and warned the soldiers in the vicinity of the impending attack before they (insurgents) eventually overran the town and started shooting.<br /> <br /> Meanwhile, a source in the town also told Sahara Reporters that the insurgents came in their numbers with several vans to ransack the town, looting pharmaceutical shops and homes for foodstuffs.<br /> <br /> The source said, “They had unfettered access because a battalion of troops in the town was withdrawn sometime back, leaving behind just a few soldiers who could not repel the insurgents. After looting, they burnt down a police barracks, police station, two churches; Living Faith and EYN, and a shopping mall.<br /> <br /> “People were also killed but I have no record as of now. They also razed General Paul Tarfa’s residence, among other important buildings in the town.”<br /> <br /> A tweet by @tntmagazinenigeria also showed a church that was eventually burnt by the insurgents. It read, “Where several houses, which included those of prominent sons of Garkida, market, churches; EYN, Living Faith and Anglican burnt. Rural health centre, two ambulances burnt while another two taken by the insurgents.<br /> <br /> “Two soldiers lost their lives, civilian casualties yet to be ascertained, the police station and barracks burnt. The attack left a devastating little town of Garkida. News from sources in the village says the insurgents came in about nine truckloads of their men and more than 50 motorcycles carrying at the least, two persons.<br /> <br /> <br /> “The saddest part is that some people from the very town of Garkida who were recruited by the insurgents were the ones selectively showing the insurgents which properties to set ablaze. My heart bleeds for this nation we call Nigeria.”<br /> <br /> Also, the Cavell Group, a consultant in intelligence, risk, crisis and expedition, in a series of tweets via @TCG_CrisisRisks, noted that many of the villagers were able to escape into the bush while some were abducted.<br /> <br /> The tweet added, “A group with hostages left in a large convoy in the North-East towards Borno. There was still sporadic fighting well after midnight. ISWAP (has) now claimed responsibility with claims they killed three soldiers. No word on hostages. At least two soldiers confirmed killed and three Christians were taken from a church. However, many more reported taken. Significant damage to town, hospital and police barracks.”<br /> <br /> It was also gathered that there was a military aircraft that flew in the airspace but that it wasn’t seen firing any shots.<br /> <br /> According to sources in the community, a military contingent used to be in the town and nearby villages but was withdrawn recently leaving a small contingent of soldiers.<br /> <br /> Meanwhile, a former vice-president and presidential candidate of the opposition Peoples Democratic Party in the 2019 elections, Atiku Abubakar, on Saturday decried the attacks on his Twitter page, while lamenting the increasing attacks by the insurgents.<br /> <br /> In his verified Twitter handle @atiku, he also condoled with the affected families in Garkida.<br /> <br /> He wrote, “The attack by Boko Haram against lives and properties of innocent Nigerians is unbecoming. My prayers are with the people of Garkida in my home state of Adamawa over the cowardly attack that happened over the weekend. May God give the affected families fortitude to bear the loss.”

Each one of them wanted to leave the office better than they met it.<br /> <br /> “So, it stands to reason that when you work with other occupants of the office, you stand to benefit from their experience. That was what these meetings were about.”<br /> <br /> According to the Presidency, Mrs Buhari plans to make a difference by having a “solid structure” to sustain her pet projects beyond her stay in office, like the Aisha Buhari Foundation and the Future Assured Initiative.<br /> <br /> Abdullahi added, “If you look at some of the former first ladies, they just had the pet projects, but they didn’t have a sustained platform.<br /> <br /> “The difference is, there is now Aisha Buhari Foundation, then there is the Future Assured Initiative as a vehicle and others on the foundation.<br /> <br /> “So, the foundation, which has funding support from partners like the Bill and Melinda Gates Foundation, will outlive the founder even if the projects go after the founder has left office.<br /> <br /> “The issue of politics doesn’t even come. Politics how?”<br /> <br /> After her February 10 meeting with Mrs Jonathan, the President’s wife went to her Facebook page and wrote that their discussions centred on women participation in politics, girl-child education and Mrs Jonathan’s pet project, ‘Women for Change.’<br /> <br /> She stated, “I got to hear her experience during her tenure and listened to her perspectives on the issues affecting women and children in society.<br /> <br /> “It was really nice having her around and I look forward to having more of such moments.”<br /> <br /> It was the first visit by Patience to the State House since her husband lost the 2015 presidential poll and handed over power to the President, Major General Muhammadu Buhari (retd), on May 29.<br /> <br /> Oh her part, Turai had vacated the State House following her husband’s death in May, 2010, did not pay any visit to the Villa during the tenure of former President Goodluck Jonathan, who succeeded her husband.<br /> <br /> Patience took over from Turai as first lady, while Aisha assumed the role after Patience’s exit.
