The All Progressives Congress, APC, in Enugu State has announced the expulsion of forty-one (41) members from the party.
This is following their alleged violation of the provision of the party’s constitution.
Those affected include a former Speaker of the Enugu State House of Assembly, Hon. Eugene Odo, former military governor, Group Capt. Joe Orji, a former Deputy Governorship candidate of the party in the State, Prince Chikwado Chukwunta, Gen. J.O.J Okoloagu, a former Reps member, Chukwuemeka Ujam and several others.
Chairman of the APC Caretaker Committee in the State, Dr. Ben Nwoye announced this when he addressed journalists on Sunday.
<a id="more" name="more"></a>
Nwoye said the members self-expelled themselves from the party by filing a suit in court without first exhausting the internal mechanisms as provided in the APC Constitution.
Article 21 (D), Section V of the APC Constitution provides that, “any member who files an action in court of law against the party or any of its officers on any matters relating to the discharge of the duties of the party without first exhausting the avenues for the redress provided for in this Constitution shall automatically stand expelled from the party on filing such action and no appeal against expulsion as stipulated in this clause shall be entertained until the withdrawal of the action from court by the member.”
It was learnt that the party members dragged Nwoye before a Federal High Court sitting in Abuja seeking his removal from office.
In the suit No: FCT/HC/CV/2107/2021, they had sought an ex parte order to stop Nwoye from parading himself as the chairman of the party.
However, the vacation judge, Justice Sylvanus Chinedu Oriji refused to grant the interlocutory injunction. Instead, it ordered that the motion on notice and the entire case be assigned to a regular court at the end of vacation for full determination of the matter.
The Judge held that, “The Defendants/Respondents shall be put on notice of the application for injunction. The orders sought in the ex parte application No. M/5317/2021 are refused.”
Speaking on the development, Nwoye said 41 members who filed the suit had automatically expelled themselves from the party.
According to him, “I arrived at my home and I found a copy of a lawsuit pasted on my door, within that lawsuit is an order sought by the applicants but was denied by the court.
“One Prince Gilbert Chikwado Chukwunta and 40 others filed a claim against me; they sought an ex parte order before an FCT High Court, seeking to remove me as the chairman of the party in Enugu State.
“They sued me and alleged among other things that I was suspended by certain persons, who they attached their signatures, but the learned jurist denied giving the order. He directed them to serve me, but instead of serving me as ordered by the court, they pasted it on my door.
“But what is important is that for those who said that Ben Nwoye has been removed, the removal of Ben Nwoye is now a subject of court, and the court has refused to remove me. I wasn’t there but the learned judge refused to remove me.
“The other point is that the petition which they signed, they forged numerous people’s signatures; one of the people they forged their signature is Mrs. Kate Offor, she never signed a petition seeking to remove me.
“We also had many other people claiming to be members of State exco, and one of such persons are Eugene Odo. Enugu State APC is no longer running on SEC; it is a caretaker committee, so being a former Speaker does not make Eugene Odo a member of APC caretaker committee. Gen. J.O.J. Okoloagu is also not a member of the caretaker committee, so also the former member of the House, Hon. Chukwuemeka Ujam, who they alleged signed, he has never been and is not a member of state exco, we also have one Anayo Ene, we also have Group Capt. Orji, Dr. Mrs. Chukwuani, Hyacinth Nsude, are not members of APC caretaker committee.
“If indeed these individuals did not sign it, those who filed this suit have committed forgery. But if those individuals say that they actually signed it, they have committed fraud because they are not members of APC caretaker committee and that includes Chikwado Chukwunta.
“Recall that Chikwado Chukwunta ran for Deputy Governor of Enugu State in 2019. After he lost, he went away, he never received a waiver before he ran, so, resigned his position. And when the exco was dissolved, Chikwado Chukwunta was never sworn-in as a member of APC caretaker committee.
“These are facts Senator Ken Nnamani and others are hiding to be deceiving the public. Having said that, the status of my chairmanship is now before the court, no one can interfere in my chairmanship, the court has already ruled by denying them the attempt to remove me.
“The next thing is that they have now all expelled themselves from the party; they were deceived into dragging an officer of the party to court.
“All these individuals by the operations of the constitution have expelled themselves from the party because they did not exhaust the internal alternative dispute resolution mechanisms.
“They are 41 persons and Chikwado Chukwunta put up an affidavit that he has their consent to file the suit. All of them are now expelled from the party.”

Bandits trying to escape the ongoing military operation in Zamfara and Katsina states met their waterloo in the hands of soldiers at Maganda village near Allawa in Shiroro Local Government Area of Niger State.
The bandits, who were said to be escaping through the notorious Allawa Forest in their hundreds, ran into the military camp stationed at Alawa, and engaged the soldiers in a serious gun battle for several hours.
One soldier was reportedly missing at the end of the gun battle.
It was also learnt that scores of the bandits were neutralised and several others escaped into the forest with bullets injuries.
<a id="more" name="more"></a>
It was gathered that the bandits who escaped with serious bullets wounds are trailed by the soldiers as the entire forest is being combed.
It was gathered that about six machine guns and a number of AK-47 riffles and bags of ammunitions were recovered from the bandits.
A source at Allawa community said, “In fact from the dead bodies that we saw, they look like foreigners, all of them are carrying long hair like women. They don’t have resemblance of Nigerians and they don’t know the terrain that was why they ran into the soldiers. They did not know that there is soldiers camp there.”
Bandits had in April invaded the Military Base in Alawa, and killed five soldiers and a mobile policeman.
The entire military camp was razed by the armed bandits who invaded the base about 3:00 am when soldiers had just returned to their base from an area patrol.
After the invasion of the military base, the bandits moved to the community where they killed seven people and abducted a number of villagers.

The Federal Capital Territory (FCT) Police Command has apprehended a fake prophet, Bola Wasiu Adebola.
CP Babaji Sunday announced the arrest in a brief on recent successes by the command’s operatives.
He said detectives from the anti-violent crime section arrested Wasiu for obtaining money under false pretence.
The 45-year-old was said to have fraudulently obtained money from his victims under the guise of fortune telling.
<a id="more" name="more"></a>
Wasiu allegedly defrauded a victim of N800,000 before he was caught around Area One in Abuja.
Also, operatives from the Bwari Division foiled a kidnap attempt by Nyale Kachia, Sani Damina and Yusuf Samaila.
The suspects confessed that they tried to abduct Kachia’s uncle along the Bwari axis.
Exhibits recovered from the suspects include one machete and two sticks.

Saul Niguez has admitted his Chelsea debut did not go according to plan, after he endured a difficult 45 minutes on Saturday.
The midfielder, on loan from Atletico Madrid, was included in the Blues’ starting XI for the visit of Aston Villa.
But Saul had a poor debut, which led to Thomas Tuchel taking him off at half time and bringing on Jorginho.
The 26-year-old was guilty of giving the ball away too many times, failing to press and dallying in possession and being caught out.
<a id="more" name="more"></a>
Several times, Edouard Mendy and Thiago Silva had to bail him out.
“Wasn’t the expected debut,” Saul wrote on social media, along with a picture of him with his new teammates.
“Really happy with my first game and victory with the team. Incredible to see Stamford Bridge full of Blues.”

The Chief Justice of Nigeria, Justice Ibrahim Tanko Muhammad, has ordered the Judicial Service Committee (JSC) of the Federal Capital Territory (FCT) to immediately initiate disciplinary action against the Upper Area Court Judge who issued direct criminal summons against a former governor of the Central Governor of Nigeria (CBN), Professor Charles Chukwuma Soludo.
The judge, whose name is being withheld, issued the criminal charges against the governorship candidate of the All Progressives Grand Alliance (APGA) in Anambra State over alleged serial abuse of office and breach of Code of Conduct for public officers when he was the Governor of Central Bank of Nigeria between 29 May 2004 – 29 May 2009.
The Upper Area Court had on 23 August 2021 issued a direct criminal summons against Soludo over perjury, corruption and false assets declaration which is completely outside the jurisdiction of the Upper Area Court.
FCT Judicial Service Committee is under the Chairmanship of the Acting Chief Judge, Hon. Hussein Baba Yusuf.
<a id="more" name="more"></a>
A top source told our correspondent that “from all indications, the Chief Justice of Nigeria and Chairman National Judicial Council, Justice Ibrahim Tanko Muhammad, seems determined to put an end to impunity and misconduct in the Judiciary”.
It would be recalled that Muhammad had met with the chief judges of the FCT, Rivers, Kebbi, Cross River, Jigawa, Anambra and Imo states on Monday 6 September 2021 and directed some of them to admonish the judges in their jurisdictions on the danger of granting ex parte injunctions.
The acting Chief Judge of the Federal Capital Territory is expected to submit his findings to the CJN within 21 days.

An immigrant from the Republic of Benin, Adamu Sabi Sime, has been arrested by the Kwara State Command of the Nigeria Security and Civil Defence Corps, NSCDC, for allegedly having carnal knowledge of his biological mother.
Babawale Zaid Afolabi, spokesman of the command, said Adamu’s mother, Fati Sime, had produced three children for her son.
“On Thursday, September 09,2021, one Malam Bandele, the district head of Moshe Community in Kaiama Local Government Area of Kwara state, reported the incestous act committed by one Adamu Sabi Sime and his mother, Fati Sime of the same community.
“Men from the intelligence unit and NSCDC operatives in Kaiama swung into action and the outcome of investigations established the fact that the mother (Fati) has three children for her biological son,” he said.
<a id="more" name="more"></a>
Babawale, said further checks revealed that “the younger brother of the suspect, who was also confirmed to be sleeping with the mother, is now at large.”
The spokesman disclosed that the mother and her two sons don’t have the necessary papers to stay in Nigeria.
“They have been handed over to the Nigeria Immigration Service, NIS, for background checks and further action,” he added
